Police ID pedestrian hit, killed on U.S. 40

Shown early Sunday at the scene of the fatal crash, state police on Tuesday identified a pedestrian who was hit on Pulaski Highway (U.S. 40) as a Dover-area woman.

State police on Tuesday said a pedestrian hit and killed last weekend in Bear was a Dover-area woman.

She was identified as 58-year-old Brenda L. Stone, Sgt. Richard D. Bratz said.

Just before 11 p.m. Saturday, Stone was hit as she tried to cross westbound lanes of Pulaski Highway (U.S. 40) between Christiana-Bear Road (Del. 7) and Quintilio Drive, not using a marked crosswalk, Bratz said.

The fatal crash, in the area of the Governor’s Square Shopping Center, remains under investigation by the Delaware State Police Collision Reconstruction Unit.

The driver of the car that struck Stone was charged with driving under the influence and operation of an unregistered vehicle, Bratz said.

Despite those charges filed against Terry Berry, 33, of Newark, however, police concluded that the pedestrian mainly was responsible for the fatality because she failed to use a cosswalk and stepped into the path of traffic.

“Alcohol appears to be a factor on the part of the pedestrian,” Bratz said Sunday.

She was hit as she walked into the center lane and the path of Berry’s 2009 Toyota Camry, police said. Berry continued to drive west, but U-turned and returned to the collision site, they said.

The westbound side of the highway was closed for about three hours in the area of the fatality. Also responding to the crash were crews from Christiana and Delaware City fire companies.
